TERMS OF SERVICE

Welcome to Libertarians. These Terms of Service ("Terms") govern your access to and use of libertarians.com (the "Site") and the purchase of products offered on the Site. By accessing or using the Site, you agree to be bound by these Terms. If you do not agree, do not use the Site.
1. DEFINITIONS
"Libertarians," "we," "us," and "our" refer to Libertarians, headquartered in Miami, Florida, United States.
"You" and "your" refer to the user or purchaser accessing the Site.
"Products" refers to the sweaters and apparel items sold on the Site.
"Order" refers to any purchase submitted through the Site.
2. ELIGIBILITY
By using this Site, you represent and warrant that:
a) You are at least eighteen (18) years of age, or you are using the Site under the supervision of a parent or legal guardian who agrees to be bound by these Terms.
b) You have the legal capacity to enter into a binding contract.
c) You are not barred from using the Site under the laws of the United States or any other applicable jurisdiction.
d) You will comply with all applicable local, state, national, and international laws when using the Site.
3. ACCOUNT REGISTRATION
When creating an account, you agree to:
a) Provide accurate, current, and complete information.
b) Maintain and promptly update your account information.
c) Maintain the security and confidentiality of your password.
d) Accept responsibility for all activities that occur under your account.
e) Notify us immediately of any unauthorized use at support@libertarians.com.
We reserve the right to suspend or terminate accounts that violate these Terms, provide false information, or engage in fraudulent activity.
4. PRODUCTS AND PRICING
a) ACCURACY: We make every effort to display Products and prices accurately. However, we do not warrant that product descriptions, colors, pricing, or other content on the Site is error-free.
b) COLOR DISPLAY: Due to differences in monitors and screens, actual product colors may vary slightly from what you see on your screen.
c) PRICING: All prices are listed in United States Dollars (USD) unless otherwise stated. Prices are subject to change without notice.
d) PRICING ERRORS: In the event of a pricing error, we reserve the right to cancel any orders placed at the incorrect price, whether or not the order has been confirmed and charged.
e) AVAILABILITY: All Products are subject to availability. We reserve the right to limit quantities, discontinue products, or refuse any order at our sole discretion.
5. ORDERS AND PAYMENT
a) ORDER ACCEPTANCE: Your submission of an order constitutes an offer to purchase. We reserve the right to accept or decline any order for any reason, including suspected fraud, pricing errors, or stock unavailability.
b) PAYMENT METHODS: We accept major credit cards, debit cards, and other payment methods displayed at checkout. By submitting payment information, you represent that you are authorized to use the payment method and authorize us to charge the full amount.
c) FRAUD PREVENTION: We reserve the right to request additional verification before processing any order. Orders flagged as potentially fraudulent will be held or cancelled.
d) TAXES AND DUTIES: You are responsible for all applicable taxes, customs duties, and import fees in your country.
6. SHIPPING
Shipping terms, timeframes, and costs are governed by our Shipping Policy, which is incorporated into these Terms by reference.
7. RETURNS AND REFUNDS
Returns and refunds are governed by our Return and Refund Policy, which is incorporated into these Terms by reference.
8. INTELLECTUAL PROPERTY
All content on the Site — including but not limited to text, graphics, logos, images, product designs, videos, and software — is the property of Libertarians or its licensors and is protected by United States and international copyright, trademark, and other intellectual property laws.
You may not:
a) Copy, reproduce, distribute, or create derivative works from any Site content without our prior written consent.
b) Use our trademarks, logos, or brand name in any way that implies endorsement or affiliation.
c) Scrape, data-mine, or use automated tools to extract content from the Site.
d) Reverse-engineer any part of the Site or its underlying software.
9. USER CONDUCT
You agree not to:
a) Use the Site for any unlawful purpose or in violation of these Terms.
b) Transmit viruses, malware, or any harmful code.
c) Attempt to gain unauthorized access to any portion of the Site or its systems.
d) Interfere with or disrupt the Site's operation.
e) Impersonate any person or entity or misrepresent your affiliation with any person or entity.
f) Harass, abuse, or threaten any other user or our staff.
g) Submit false, misleading, or fraudulent information.
10. USER-GENERATED CONTENT
If you submit reviews, comments, photos, or other content to the Site, you grant Libertarians a non-exclusive, royalty-free, perpetual, worldwide license to use, reproduce, modify, publish, and distribute such content in any media. You represent that you own or have the necessary rights to the content you submit and that it does not violate the rights of any third party.
11. DISCLAIMER OF WARRANTIES
THE SITE AND PRODUCTS ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT ANY WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.
We do not warrant that the Site will be uninterrupted, error-free, secure, or free of viruses or other harmful components.
12. LIMITATION OF LIABILITY
TO THE FULLEST EXTENT PERMITTED BY LAW, LIBERTARIANS AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AFFILIATES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOST PROFITS, LOST DATA, OR LOSS OF GOODWILL, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE SITE OR ANY PRODUCT.
OUR TOTAL LIABILITY TO YOU FOR ANY CLAIM ARISING OUT OF OR RELATING TO THESE TERMS OR THE SITE SHALL NOT EXCEED THE AMOUNT YOU PAID TO LIBERTARIANS IN THE SIX (6) MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM.
13. INDEMNIFICATION
You agree to indemnify, defend, and hold harmless Libertarians, its officers, directors, employees, agents, and affiliates from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising out of or in any way connected with:
a) Your access to or use of the Site.
b) Your violation of these Terms.
c) Your violation of any rights of any third party.
14. TERMINATION
We reserve the right to suspend or terminate your access to the Site at any time, with or without notice, for any reason, including breach of these Terms.
15. GOVERNING LAW AND JURISDICTION
These Terms shall be governed by and construed in accordance with the laws of the State of Florida, United States, without regard to its conflict of law principles.
Any dispute arising out of or relating to these Terms or the Site shall be resolved exclusively in the state or federal courts located in Miami-Dade County, Florida, and you consent to the personal jurisdiction of such courts.
16. DISPUTE RESOLUTION AND ARBITRATION
Any dispute, claim, or controversy arising out of or relating to these Terms shall first be addressed through good-faith negotiation. If the dispute cannot be resolved within thirty (30) days, it shall be settled by binding arbitration administered by the American Arbitration Association under its Commercial Arbitration Rules.
You waive any right to participate in a class action lawsuit or class-wide arbitration.
17. CHANGES TO THESE TERMS
We reserve the right to modify these Terms at any time. Changes become effective upon posting to the Site. Your continued use of the Site after changes are posted constitutes acceptance of the modified Terms. We recommend reviewing these Terms periodically.
18. SEVERABILITY
If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall continue in full force and effect.
19. ENTIRE AGREEMENT
These Terms, together with our Privacy Policy, Shipping Policy, and Return and Refund Policy, constitute the entire agreement between you and Libertarians regarding your use of the Site.
